Pluriversal Declaration of Living Rights

This is a rip-off of the original UDHR of 1948, aimed to address « the Born ones », and to serve as a template to cut through the liberal concepts of the original text.

Pluriversal Declaration of Living Rights

Preamble

Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the living family is the foundation of freedom, justice and peace in the world,

Whereas disregard and contempt for freedom, difference, and human rights, have resulted in barbarous acts which have outraged the conscience of humankind, and the advent of a world in which human beings shall enjoy responsible and solidary life and freedom from fear and oppression has been proclaimed as the highest aspiration of the speaking people,

Whereas it is essential, for life to have recourse, as a first resort, to rebellion against tyranny and oppression, that living rights should be protected by the rule of law,

Whereas it is essential to promote the development of friendly relations between nations, and against all oppression including by States and transnational corporations,

Whereas the peoples of the United Nations have in the Charter reaffirmed their faith in fundamental human rights, in the dignity and worth of the human person and in the equal rights of men and women and have determined to promote social progress and better standards of life in larger freedom,

Whereas Member States have pledged themselves to achieve, in co-operation with the United Nations, the promotion of universal respect for and observance of human rights and fundamental freedoms, but have obviously failed to do so,

Whereas a common understanding of these rights and freedoms is of the greatest importance for the full realization of this pledge,

Now, Therefore THE GENERAL ASSEMBLY proclaims THIS UNIVERSAL DECLARATION OF LIVING RIGHTS as a common standard of achievement for all peoples and all nations, to the end that every individual and every society, keeping this Declaration constantly in mind, shall strive by teaching, education and struggle to promote respect for these rights and freedoms and by progressive measures, without borders, to secure their pluriversal and effective recognition and observance, both among the peoples of Member States themselves and among the corporations under their jurisdiction.

Article 1

All living beings are born. They are endowed with life and should act towards one another with respect. Those not born, such as machines, contractual bindings including property, corporations, States, are not subject to this Declaration.

Article 2

Every born entity is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as species, colour, gender, language, opinion, natural or social origin, birth or other status. Furthermore, distinction shall be made on the basis of proximity of the concerned regardless of the power willing to exert on them, including political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty.

Article 3

Every born being has the right to life, liberty and integrity of person. This does not apply to unborn entities, such as corporations, States, national or international organizations, and organizations servicing the Unborn, such as software, machines, factories, armies, police, criminal and terrorist organizations, including nation-States.

Article 4

No born being shall be held in slavery or servitude; slavery and the slave trade shall be prohibited in all their forms.

Article 5

No born one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment, including imprisonment and the death penalty.

Article 6

Every born one has the right to recognition everywhere as a person, including before the law. Therefore everyone and everything has the responsibility to treat every born being with respect.

Article 7

All born ones are equal before the law and are entitled without any discrimination to equal protection of the law. All born ones are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination.

Article 8

Every born one has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted them by the constitution or by law. If such tribunals are ineffective, every born one has the right to rebellion and direct justice, within the limits of this Declaration.

Article 9

No born one shall be subjected to arbitrary arrest, detention, exile, or death.

Article 10

Every born one is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of their rights and obligations and of any criminal charge against them.

Article 11

  1. Every born one charged with a penal offence has the right to be presumed innocent until proved guilty according to natural law in a public trial at which they have had all the guarantees necessary for their defence.
  2. Every born one shall be held guilty of penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed, when the act or omission resulted in substantial destruction of other living beings, including self.

Article 12

No born one shall be subjected to arbitrary interference with their privacy, family, home or correspondence, nor to attacks upon their honour and reputation. Every born one has the right to the protection of the law against such interference or attacks. If the law cannot protect them, they have the right to rebellion against their oppressor.

Article 13

  1. Every born one has the right to freedom of movement and residence anywhere on their planet, assuming their movement or residence do not harm other born ones to the point that Article 11 would apply.
  2. Every born one has the right to cross any borders that may be, including those they do not recognize.

Article 14

  1. Every born one has the right to seek and to enjoy asylum from persecution.
  2. This right may not be invoked in the case of prosecutions genuinely arising from non-political crimes, such as financial fraud, or from acts contrary to this Declaration, such as destroying an ecosystem, or the purposes and principles of the United Nations.

Article 15

  1. Every born one has the right to be a member of society.
  2. No born one shall be arbitrarily deprived of their membership nor denied the right to change their affiliation as they wish.
  3. No society can seek a born one’s punishment for exerting this right.

Article 16

  1. Every born one of full age, without any limitation due to species, have the right to associate with other born ones to found a society. They are entitled to equal rights as to association, during association and at its dissolution.
  2. Association shall be entered into only with the free and full consent of the intending members.
  3. The association is the natural and fundamental unit of society and is entitled to protection by society and against the State.

Article 17

  1. No unborn one has the right to property.
  2. No born one has the right to private property.[1]
  3. Every born one has the right to share commons in association with others.
  4. Every sole proprietor shall be arbitrarily deprived of their property.
  5. Expropriated property shall become a commons and be governed as such by the free association of its born users.

Article 18

Every born one has the right to freedom of thought, conscience and religion ; this right includes freedom to change their religion or belief, and freedom, either alone or in community with others and in public or private, to manifest their religion or belief in teaching, practice, worship and observance ; this right excludes harassing or submitting others, or depriving others from their own freedom of thought, conscience and religion.

Article 19

Every born one has the right to freedom of opinion and expression ; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers ; this right excludes harassing born ones who think differently : agression is not an expression of freedom, but one of oppression.

Article 20

  1. Every born one has the right to freedom of peaceful assembly and association.
  2. Every born one has the right to freedom of rebellion and revolt against the abusive unborn.
  3. No one may be compelled to belong to an association.

Article 21

  1. Every born one has the right to dismantly the government of their country, directly or through freely chosen representatives.
  2. Every born one has the right of equal access to public service anywhere they happen to be.
  3. The existence of the born ones shall be the basis of any authority ; this existence shall be celebrated in periodic and genuine festivals which shall be a moment to destroy riches and unborn authority.

Article 22

Every born one, as a member of society, has the right to social security and is entitled to realization of the social, cultural, and political rights indispensable for their dignity and the free development of their personality.

Article 23

  1. Every born one has the right to work if they wish to contribute to the well-being of society.
  2. Every born one has the right to form and to join workers and farmers unions for the protection of general interest.
  3. Every born one has the right to rest and leisure, including reasonable working hours and periodic paid work.

Article 24

  1. Every born one has the right to just and favourable remuneration ensuring for themself and their association an existence worthy of living dignity, and supplemented, if necessary, by other means of social protection.
  2. Every born one, without any discrimination, has the right to equal pay for equal work.
  3. No born one may earn more than three times the basic pay.
  4. Since no unborn has any right over property, no unborn can earn pay.

Article 25

  1. Every born one has the right to a standard of living adequate for the health and well-being of themself and of their society, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond their control.
  2. Motherhood and childhood are entitled to special care and assistance. All children shall enjoy the same social protection.

Article 26

  1. Every born one has the right to education. Education shall be free, including technical and professional education. Higher education shall be made generally available and equally accessible to all.
  2. Education shall be directed to the full development of the born one personality and to the strengthening of respect for living rights and fundamental freedoms. It shall promote understanding, tolerance and friendship among all nations, species, and shall further the activities of the United Nations for the furtherance of peace.
  3. Children have a prior right to choose the kind of education that shall be given to them.

Article 27

  1. Every born one has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits.
  2. Every born one has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of the born ones, especially from the abuse of unborn interests.

Article 28

Every born one is entitled to a social and pluriversal order in which the rights and freedoms set forth in this Declaration can be fully realized.

Article 29

  1. Every born one has duties to the community of the living in which alone the free and full development of their personality is possible.
  2. In the exercise of their rights and freedoms, every born one shall be subject only to such limitations as are determined by society solely for the purpose of securing due recognition and respect for the rights and freedoms of other born ones and of meeting the just requirements of respect, public order and the general welfare in a pluriversal society.

Article 30

Nothing in this Declaration may be interpreted as implying for any born or unborn any right to engage in any activity or to perform any act aimed at the sapping or destruction of any of the rights and freedoms set forth herein.
